1. Acceptance of Terms

By accessing or using the Mockup Now application and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Mockup Now is a design tool that allows users to create professional product mockups using 3D rendering, AI-powered scene and artwork generation, and customizable garment templates. The Service is available as a mobile application and web application.

3. User Accounts

You may need to create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions and Purchases

Certain features of the Service require a paid subscription ("Mockup Now Pro"). Subscriptions are billed through the platform on which you made the purchase (e.g., Apple App Store). Subscription terms, pricing, and renewal policies are presented at the time of purchase.

  • Subscriptions automatically renew unless canceled before the end of the current billing period.
  • You may manage or cancel your subscription through your device's app store settings.
  • Refunds are subject to the policies of the applicable app store.

5. User Content

You retain all rights to the designs, images, and other content you create using the Service ("User Content"). By using the Service, you grant us a limited license to process your User Content solely for the purpose of providing the Service to you.

You represent and warrant that:

  • You own or have the necessary rights to use any images or designs you upload to the Service.
  • Your User Content does not infringe upon the intellectual property rights of any third party.
  • Your User Content does not contain unlawful, harmful, or objectionable material.

6. AI-Generated Content

The Service includes AI-powered features for generating artwork and mockup scenes. You acknowledge that:

  • AI-generated content is created algorithmically and may not always meet your expectations.
  • You are responsible for reviewing and ensuring the appropriateness of AI-generated content before using it commercially.
  • Subject to these Terms, you may use AI-generated content created through the Service for personal and commercial purposes.

7. Intellectual Property

The Service, including its design, features, 3D models, software, and branding, is owned by Mockup Now and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code.

8. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Use automated means (bots, scrapers) to access the Service
  • Upload content that contains malware or harmful code
  • Impersonate any person or entity
  • Use the Service to create content that infringes on others' intellectual property

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOCKUP NOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Mockup Now and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Mockup Now operates, without regard to its conflict of law provisions.
